CRIMINAL COURT RESOURCES

Will A Criminal Conviction Affect Your Immigration Status?

Yes, almost always. Many criminal convictions, including misdemeanors, can cause severe immigration consequences including: deportation, detention, inability to obtain lawful resident status, inability to naturalize. This is true even if you sentence is “withheld,” “suspended” or if you never spend one day in jail. These consequences are separate from criminal court proceedings and in addition to your criminal sentence.

Many criminal defense lawyers have little to no training in immigration law. Make sure that you understand how conviction for any crime will affect your immigration status and goals before you decide how to resolve your case.
